Arcana Alarm

These Terms of Use ("Terms") are an agreement between you and the developer of Arcana Alarm, a sole independent developer ("we", "us"). By downloading or using Arcana Alarm (the "App"), you agree to these Terms. If you do not agree, please do not use the App.

1. What the App is

Arcana Alarm is an alarm clock. To dismiss an alarm, you erase a shape on the screen. After dismissing, the App shows you a "tarot card of the day" with a short reading, and keeps a journal of the cards you have collected.

2. Entertainment disclaimer — please read this

Tarot readings in the App are for entertainment and inspiration only. They are randomly drawn cards with light-hearted interpretations. They are not medical, psychological, financial, legal, or any other kind of professional advice, and they do not predict the future. Do not make decisions based on them. If you need real advice, talk to a qualified professional.

Do not rely on the App as your only alarm for critical situations (flights, exams, medication, work shifts, or anything else important). The App makes a best effort to ring, but alarms depend on factors outside our control: your device's battery and volume, Focus and system settings, iOS behavior, and software updates. For anything critical, set a backup alarm on another device.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, in line with these Terms and Apple's App Store rules. Apple's standard Licensed Application End User License Agreement also applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

You may not copy, modify, reverse-engineer, resell, or redistribute the App except where the law expressly allows it.

4. Intellectual property

The tarot card images in the App are from the Rider-Waite deck (1909), which is in the public domain.

Everything else in the App — including the card interpretations, text, design, animations, and code — belongs to the developer and is protected by copyright and other laws. You may not reuse it outside the App without written permission.

5. Your content

You can import audio files into the App to use as alarm sounds. You are responsible for the files you import: make sure you have the right to use them. Imported files stay on your device; we never receive them. We are not responsible for the content of files you import.

6. Purchase

The App is a paid app: you pay once when you download it from the App Store, and it is yours to keep. There is no subscription and nothing renews automatically. Payments and refunds are handled by Apple under the App Store terms.

7. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, missed appointments, missed flights, lost data, or oversleeping, arising from your use of (or inability to use) the App. Our total liability for any claim will not exceed the amount you paid for the App in the twelve months before the claim, or USD 10 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law.

9. Termination

You can stop using the App at any time by deleting it. We may terminate or suspend your license if you breach these Terms. Sections 2, 4, 7, 8, and 10 survive termination.

10. Governing law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules. Mandatory consumer protection laws of your country of residence still apply where they cannot be waived.

11. Changes to these Terms

We may update these Terms from time to time. The current version, with its effective date, will always be available where the App links to it. If you keep using the App after changes take effect, you accept the updated Terms. Material changes will be noted in the App or in release notes.
